Mit der Umsetzung der Richtlinie über bestimmte vertragsrechtliche Aspekte der Bereitstellung digitaler Inhalte und Dienstleistungen (RL 2019/770) und der Richtlinie über bestimmte vertragsrechtliche Aspekte des Warenkaufs (RL 2019/771) hat das deutsche Verbraucherrecht eine der größten substantiellen Änderungen seit der Schuldrechtsreform durchlaufen. Vor allem die Umsetzung der Digitale-Inhalte-Richtlinie stellt das deutsche Recht dabei vor große Herausforderungen. Das "Update" des BGB mit Blick auf Sachverhalte der Digitalisierung war überfällig und ist zu begrüßen. Dass es bei der Umsetzung solch weitreichender, strukturfremder Regelungen zu Friktionen kommt, kann kaum verwundern. Die Tagung "Verträge über digitale Inhalte und digitale Dienstleistungen" hatte es sich zum Ziel gesetzt, die Neuregelungen näher zu beleuchten und erste Problemfelder aufzuzeigen. Neben Fragen der Vertragsgestaltung bei der Bereitstellung digitaler Inhalte wurde auch die Qualität digitaler Dienstleistungen, das Verhältnis zu den Nachbarregimen und die Plattformqualität im Lichte der geplanten Neuregelungen thematisiert.

This book provides rule-by-rule commentaries on the Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market. The eIDAS regulation aims at proving a framework for secure and trustworthy electronic transactions in the EU. This volume offers comprehensive comments on all provisions of this regulation containing references to European scholarly writing. As a cross-border project this book is written by an international group of contributors and provides analysis from different European countries. In order to assess the arising legal issues the contributions to this book reflect both aspects of the eIDAS regulation: On one hand the technological-neutral approach intended by this regulation, but also the nevertheless technically determined definitions and provisions of this very specific field of law.

The German Association of Comparative Law presents in this volume the German contributions to the 21st International Congress of Comparative Law 2022 in Asuncion (Paraguay) organised by the International Academy of Comparative Law. One main topic of the congress is the digitalization and its legal, social and economic consequences, including the phenomenon of hate speech, smart contracts, streaming and artificial intelligence accountability of public administration. A further set of papers refers to climate change and bioethics. Several contributions deal with classical topics of comparative law from a more contemporary perspective, such as access to justice, emergency law, force majeure, and the rule of law. The volume provides an overview of the state of discussions within German legal scholarship.
